Israeli bulldozers demolished the house of the Mufti Haj Amin al-Husseini (Shepherd Hotel) in the neighborhood of Sheikh Jarrah in Jerusalem


Israeli Occupation Forces (IOF) Continued Systematic Attacks against Palestinian Civilians and Property in the Occupied Palestinian Territory (OPT)

· IOF extra-judicially executed a Palestinian civilian in Hebron and an activist in the Gaza Strip.

· IOF killed two Palestinian civilians in the West Bank and the Gaza Strip.

Two Palestinian civilians were wounded by Israeli gunfire in the West Bank and the Gaza Strip.

· IOF continued to target Palestinian workers, farmers and fishermen in border areas in the Gaza Strip.

IOF arrested 4 Palestinian fishermen, including two children.

· Israeli warplanes attacked a number of targets in the Gaza Strip.

A number of training sites were bombarded.

· IOF continued to use force against peaceful protests in the West Bank.

4 Palestinian civilians, including a child, were wounded.

IOF arrested a Palestinian civilian.

· IOF conducted 40 incursions into Palestinian communities in the West Bank and a limited one into the Gaza Strip.

IOF arrested 15 Palestinian civilians, including a member of the Palestinian Legislative Council and 3 children.

· Israel has continued to impose a total siege on the OPT and has isolated the Gaza Strip from the outside world.

Israeli soldiers positioned at military checkpoints in the West Bank arrested two Palestinian civilians.

· Israel has continued to take measures aimed at creating a Jewish demographic majority in Jerusalem.

IOF demolished the Mufti Headquarter (Shepherd Hotel) in East Jerusalem.

· IOF have continued settlement activities in the West Bank and Israeli settlers have continued to attack Palestinian civilians and property.

IOF demolished 13 houses, rendering 40 Palestinian civilians homeless.

IOF demolished 3 classrooms, 3 barnyards and 3 tents in Hebron.

Summary

Israeli violations of international law and humanitarian law in the OPT continued during the reporting period (06 – 12 January 2011):

Shooting:

During the reporting period, IOF killed 4 Palestinians, including 3 civilians, and wounded 6 others, including a child, in the West Bank and the Gaza Strip.

On 07 January 2011, IOF killed and old man and arrested the targeted person in Hebron. IOF admitted responsibility for the attack, but claimed that Israeli soldiers fired at the victim by mistake. An Israeli military spokesman claimed that the soldiers “fired at him thinking that he was armed and might pose a threat to their lives.” Israeli soldiers apparently thought the victim was a wanted person.

On 08 January 2011, Israeli soldiers positioned at al-Hamra checkpoint, southeast of Tubas, killed a Palestinian civilian. Initial investigations conducted by IOF indicated that the victims did not pose and threat to the lives of Israeli soldiers. It is worth noting that Israeli soldiers positioned at the same checkpoint killed another Palestinian civilian in similar circumstances on 02 January 2011.

On 10 January 2011, a Palestinian civilian was wounded when IOF that had moved into Beit Liqya village, west of Ramallah, fired at a number of children and young men who threw stones at IOF military vehicles.

During the reporting period, IOF used excessive force to disperse peaceful demonstrations organized in protest to Israeli settlement activities and the construction of the annexation wall. As a result, 4 Palestinian civilians, including a child, were wounded, and dozens of Palestinian civilians and international human rights defenders suffered from tear gas inhalation or sustained bruises. IOF also arrested a Palestinian civilian.

In the Gaza Strip, on 10 January 2011, IOF shot dead a Palestinian farmer who was working on his land in the northern Gaza Strip town of Beit Hanoun.

On 11 January 2011, IOF extra-judicially executed an activist of the al-Quds Brigades (the armed wing of Islamic Jihad) in the southern Gaza Strip. An Israeli drone fired the victim while he was riding a motorcycle. They claimed that he was preparing for “a terrorist attack.” A civilian bystander was also wounded.

During the reporting period, Israeli warplanes attacked a number of targets in the Gaza Strip. They bombarded a number of training sites of Palestinian resistance groups.

On 07 January 2011, Israeli gunboats opened fire at Palestinian fishing boats in the northern Gaza Strip, but no casualties were reported. On 11 January 2011, IOF arrested 4 Palestinian fishermen, including two children, but released them later, excluding one.

Incursions:

During the reporting period, IOF conducted at least 40 military incursions into Palestinian communities in the West Bank, during which they arrested 15 Palestinian civilians, including a member of the Palestinian Legislative Council and 3 children.

In the Gaza Strip, IOF conducted one limited incursion, during which they leveled areas of Palestinian land, which they had already razed.

Restrictions on Movement:

Israel had continued to impose a tightened siege on the OPT and imposed severe restrictions on the movement of Palestinian civilians in the Gaza Strip and the West Bank, including occupied East Jerusalem.

Gaza Strip

Israel has continuously closed all border crossings to the Gaza Strip for over three years. The illegal Israeli-imposed closure of the Gaza Strip, which has steadily tightened since June 2007, has had a disastrous impact on the humanitarian and economic situation in the Gaza Strip.

· The illegal closure has caused not only a humanitarian crisis but a crisis of human rights and human dignity for the population of the Gaza Strip. Measures declared recently to ease the blockade are vague, purely cosmetic and fail to deal with the root causes of the crisis, which can only be addressed by an immediate and complete lifting of the closure, including lifting the travel ban into and out of the Gaza Strip and the ban on exports. PCHR is concerned that the new Israeli policy is simply shifting Gaza to another form of illegal blockade, one that may become internationally accepted and institutionalized. Palestinians in Gaza may no longer suffer from the same shortage of goods, but they will remain economically dependent and unable to care for themselves, and socially, culturally and academically isolated from the rest of the world.

· Expanding the list of items allowed into Gaza does not change the illegality of this policy, which is inconsistent with Israel’s legal obligations both as an Occupying Power and under international human rights treaties to which it is party, such as the International Covenant on Civil and Political Rights.

· Facts on the ground refute Israeli claims with respect to the easing of the closure imposed on the Gaza Strip and the reduction of restrictions imposed on the entry of goods.

· Israeli declaration of allowing new goods to be entered into the Gaza Strip constitutes an attempt to delude the international community, as such goods do not meet the minimal needs of the Gaza Strip.

· IOF have continued to ban the entry of raw construction materials into the Gaza Strip.

· IOF have imposed a ban on all exports from the Gaza Strip.

· Israel had continued to close Beit Hanoun (Erez) crossing to Palestinian civilians wishing to travel to the West Bank and Israeli for medical treatment, trade or social visits.

· Israel has imposed additional access restrictions on international diplomats, journalists and humanitarian workers seeking to enter the Gaza Strip. They have prevented representatives of several international humanitarian organizations from entering the Gaza Strip.

· Living conditions of the Palestinian civilian population have seriously deteriorated; levels of poverty and unemployment have mounted sharply.

West Bank

IOF have continued to impose severe restrictions on the movement of Palestinian civilians throughout the West Bank, including occupied East Jerusalem. Thousands of Palestinian civilians from the West Bank and the Gaza Strip continue to be denied access to Jerusalem.

· IOF have established checkpoints in and around Jerusalem, severely restricting Palestinian access to the city. Civilians are frequently prevented from praying at al-Aqsa Mosque in Jerusalem.

· There are approximately 585 permanent roadblocks, and manned and unmanned checkpoints across the West Bank.

· When complete, the illegal Annexation Wall will stretch for 724 kilometers around the West Bank, further isolating the entire population. 350 kilometers of the Wall have already been constructed. Approximately 99% of the Wall has been constructed inside the West Bank itself, further confiscating Palestinian land.

· At least 65% of the main roads that lead to 18 Palestinian communities in the West Bank are closed or fully controlled by IOF.

· There are approximately 500 kilometers of restricted roads across the West Bank. In addition, approximately one third of the West Bank, including occupied East Jerusalem, is inaccessible to Palestinians without a permit issued by the IOF. These permits are extremely difficult to obtain.

· IOF continue to harass, and assault demonstrators who hold peaceful protests against the construction of the Annexation Wall.

· Palestinian civilians continue to be harassed by IOF in Jerusalem, and across the West Bank, including being regularly stopped and searched in the streets by IOF.

Measures Aimed at Creating a Jewish Demographic Majority in Jerusalem:

IOF have continued to take measures at creating a Jewish majority in Jerusalem.

On 09 January 2011, IOF, accompanied by bulldozers, moved into Sheikh Jarrah neighborhood in East Jerusalem. They besieged the headquarters of Hajj Amin al-Husseini, mufti of Jerusalem and Arab nationalist leader during British rule of Palestine, which is known as “Shepherd Hotel.” They demolished the northern part of the building, which was added to the structure in the 1960s, before the heirs of Hajj Amin al-Husseini were able to obtain a court ruling suspending the demolition of the structure, which was built in the 1930s, indefinitely. IOF claim that the land on which the structure stands belongs to Miskowitz, a Jewish US millionaire, and that he took all necessary steps to demolish the building.

On 10 January 2011, IOF demolished two horse stables and confiscated two horses in East Jerusalem.

On 12 January 2011, IOF removed a commercial kiosk of kitchen tools belonging to Wa’el al-Razem in Sultan Suleiman Street in Jerusalem. IOF also confiscated goods. According to al-Razem, he establishes the kiosk more than 11 years ago, and he had not received any warning to remove it. He estimated his loss at approximately 150,000 NIS.

Settlement Activities:

Israel has continued its settlement activities in the OPT in violation of international humanitarian law, and Israeli settlers have continued to attack Palestinian civilians and property.

On Saturday, 08 January 2011, Israeli settlers from “Gilad” settlement, east of Qalqilya, attacked agricultural property belonging to ‘Aadel Hassan Yamin, 54, from Jeet village northeast of Qalqilya. As a result, the cover of a water hole was damaged.

On 10 January 2011, IOF moved into Khillat al-Jammal area in the southeast of Beit Liqya village, west of Ramallah. They handed noticed to Palestinian civilians ordering stopping the construction of a house and 3 barracks claiming that they were being built without licenses.

On 10 January 2011, IOF, accompanied by bulldozers, moved into ‘Azzoun ‘Atma village, southeast of Qalqilya. They demolished two houses. These house are located nearly 500 meters away from “Oranit” settlement and nearly 120 meters away from the annexation wall.

On 12 January 2011, during a wide scale military operation, IOF demolished several Palestinian civilian facilities in the southeast of Yatta town, south of Hebron. They demolished 11 houses, in which 27 individuals, including 17 children, live, 3 classrooms, 3 barnyards and 3 tents claiming that they are close to the annexation wall. IOF also arrested 3 Palestinian civilians.

Thursday, 06 January 2011

· At approximately 09:30, IOF moved into Shwaika suburb, north of Tulkarm. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 15:30, IOF moved into Ya’bad village, southwest of Jenin. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· Also at approximately 15:30, IOF moved into Maithaloun village, southeast of Jenin. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 16:00, IOF moved into Jaba’ village, south of Jenin. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· Also at approximately 16:00, IOF moved into Masliya village, southeast of Jenin. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· Also at approximately 16:00, IOF moved into Sanour village, southeast of Jenin. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 19:00, IOF moved into Fassayel village, north of Jericho. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 23:30, an Israeli warplane fired a missile at a site of the ‘Izziddin al-Qassam Brigades (the armed wing of Hamas) in the east of al-Shoja’iya neighborhood in the east of Gaza City. No casualties were reported. It is worth noting that the site is located near a number of schools, and it was also bombarded one month ago, which incurred damage to nearby schools.

· At approximately 23:45, an Israeli warplane fired a missile at a space area in the al-Shouka village to the east of the southern Gaza Strip town. No casualties were reported.

Friday, 07 January 2011

· In the early morning, as IOF carried out a military operation in Hebron, during which they killed an old man (see the section on extra-judicial executions below), they raided 5 houses in various areas in Hebron and arrested 5 Palestinian civilians, who had been released from detention centers of the Palestinian General Intelligence on the previous day evening:

  1. Muhannad Mahmoud Nairoukh, 23;
  2. Wissam ‘Azzam al-Qawasmi, 23;
  3. Majd Maher ‘Obaid, 21;
  4. Ahmed Mohammed al-‘Owaiwi, 24; and
  5. Mohammed Sa’id al-Beitar, 42.

· At approximately 14:30, IOF moved into Beit Liqya village, west of Ramallah. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 16:20, Israeli gunboats stationed opposite to Beit Lahia beach in the northern Gaza Strip opened fire at Palestinian fishing boats. Palestinian fishermen were forced to flee towards the beach and no casualties were reported.

· At approximately 23:00, IOF moved into Kufor Sour, south of Tulkarm. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

Saturday, 08 January 2011

· At approximately 10:00, IOF moved into Kfairet village, southwest of Jenin. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 10:15, IOF moved into Bedya village, west of Salfit. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· In the morning, Israeli soldiers positioned at al-Hamra checkpoint, southeast of Tubas, killed a Palestinian civilian. Initial investigations conducted by IOF indicated that the victims did not pose and threat to the lives of Israeli soldiers. It is worth noting that Israeli soldiers positioned at the same checkpoint killed another Palestinian civilian in similar circumstances on 02 January 2011.

According to investigations conducted by PCHR, at approximately 11:10, a Palestinian taxi arrived at al-Hamra checkpoint, southeast of Tubas. The taxi stopped waiting to be allowed to the route of car search, while the passengers stepped down to go to the checking route of pedestrians. One of the passengers, Khaldoun Majed Ahmed Samoudi, 24, who was apparently late for his work, ran towards the checking route. Israeli soldiers shouted on him and then opened fire at him from a range of nearly 15 meters. He was wounded in the chest. He was left bleeding to death. According to eyewitnesses, the victim was not carrying anything.

In his testimony to PCHR, ‘Adnan Mohammed Ghunaimi, 43, an ambulance driver, stated:

“At approximately 11:20 on Saturday, 08 January 2011, while I was on duty in Palestine Red Crescent Society, we received several phone calls from people, institution and security services that there was a wounded individual at al-Hamra checkpoint. Immediately, I, accompanied by two paramedics, drove the ambulance towards the checkpoint. We arrived there at approximately 11:45. We stopped about 300 meters away from the checkpoint. Israeli soldiers asked us what we were doing there and we told them that we learnt that there was a wounded Palestinian at the checkpoint. They asserted that, but prevented us from attending him, claiming that he might be carrying a weapon. They ordered us to move back up to 700 meters away from the checkpoint. At approximately 13:30, Israeli soldiers called on us through megaphones ordering us to prepare. We waited until 13:55, when they allowed us to move forward. We reached the victim. His face was to the ground and he was completely naked. He was covered with blood. He was hit by a bullet to the chest and another one to the abdomen. His wound was apparently not lethal, but he bled too much, so he died.”

Sunday, 09 January 2011

· At approximately 12:05, IOF moved into ‘Azzoun village, east of Qalqilya. They raided and searched a house belonging to the family of Sofian ‘Abdul Latif ‘Edwan, 44, and arrested him.

· At approximately 00:45, IOF moved into Qalqilya. They raided a building and a sewing workshop belonging to Samer Noubani. They also delivered a summon to ‘Adnan Fat’hi Daoud. No arrests were reported.

· At approximately 01:00, IOF moved into Brouqin village, northwest of Salfit. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 01:00, IOF moved into Brouqin village, northwest of Salfit. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 02:00, IOF moved into Bedya village, west of Salfit. They raided and searched a house belonging to Mahmoud Mustafa Cana’an, 44, and delivered summons to his two sons: Mustafa, 20; and ‘Aassef, 18.

· At approximately 03:30, IOF moved into al-Bustan quarter in Silwan vbillage to the south of the old town of Jerusalem. They raided a house belonging to the family of Anas Fakhri Abu Diab, 18, and arrested him.

· At approximately 08:00, IOF moved into Beit ‘Our al-Tahta village, west of Ramallah. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 10:00, IOF moved into al-Zababda village, southeast of Jenin. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· Also at approximately 10:00, IOF moved into Masliya village, southeast of Jenin. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

Monday, 10 January 2011

· At approximately 00:00, IOF moved into Kraisa area in the northwest of Dura town, southwest of Hebron. They raided and searched a number of houses and arrested 3 Palestinian civilians:

1. Yasser Mahmoud al-Rajoub, 53;

2. Yousef Nayef al-Rajoub, 20; and

3. Ahmed Badran Ebryoush, 25.

· At approximately 00:10, IOF moved into Seilat al-Harthiya village, northwest of Jenin. They surrounded a house belonging to Yahia Sa’id Zayoud, 58, a leader of Hamas. They raided the house, interrogated Zayoud and warned them of carrying out any activity against them. They left the house later and no arrests were reported.

· At approximately 01:50, Israeli helicopter gunships fired two missile at a site of the ‘Izziddin al-Qassam Brigades (the armed wing of Hamas) in the west of the southern Gaza Strip town of Khan Yunis. The site was damaged, but no casualties were reported. Less than an hour later, Israeli warplanes fired two missiles at the same site, causing more damage. No casualties were reported.

· At approximately 02:15, Israeli warplanes bombarded the yard of the Ship Building of the former Palestinian General Intelligence in the southwest of the northern Gaza Strip town of Jabalya. No casualties or damages were reported.

· At approximately 09:05, IOF moved into the area located between ‘Azzoun and ‘Izbat al-Tabib villages, east of Qalqilya. They searched the area and withdrew later.

· At approximately 10:00, IOF moved into ‘Azzoun village, east of Qalqilya. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 10:10, IOF moved into Snirya village, east of Qalqilya. They patrolled in the streets and raided a house belonging to Ameen Ahmed Younis, but no arrests were reported.

· At approximately 11:00, IOF moved into ‘Arraba village, southwest of Jenin. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 13:00, IOF moved nearly 300 meters into the east of Gaza Valley village in the central Gaza Strip. They leveled areas of Palestinian land, which they had already razed. They withdrew from the area at approximately 18:00.

· At approximately 14:05, Israeli soldiers positioned at the border between the Gaza Strip and Israel to the north of the northern Gaza Strip town of Beit Hanoun opened fire at a number of Palestinian farmers in al-Mazbala area in the north of the town. As a result, Sha’ban Mohammed Qarmout, 64, was wounded by several bullets to the heart, when he was farming his land, nearly 550 meters away from the border. He was evacuated to Beit Hanoun hospital, where he was pronounced clinically dead. At approximately 14:45, he was pronounced physically dead.

· At approximately 15:55, IOF moved into Hijja village, east of Qalqilya. They patrolled in the streets and established a checkpoint at the entrance of the village. They stopped and checked a number of Palestinian civilians. They withdrew from the village later, and no house raids or arrests were reported.

· At approximately 16:00, IOF moved into Bedya village, west of Salfit. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· Also at approximately 16:00, IOF moved into Qarawat Bani Hassan village, west of Salfit. They patrolled in the streets and held Baraa’ Sa’ed Abu ‘Elaya, 13, for an hour. They withdrew from the village later, and no house raids or arrests were reported.

· At approximately 16:00, IOF moved into Khillat al-Jammal area in the southeast of Beit Liqya village, west of Ramallah, to hand notices of demolition of Palestinian civilian property. A number of Palestinian children and young men gathered and threw stones at IOF military vehicles. Immediately, Israeli soldiers fired at them. As a result, Dirar Ahmed ‘Aassi, 20, was hit by a tear gas canister to the testicles.

· At approximately 17:00, IOF moved into Fahma village, southwest of Jenin. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 19:35, IOF moved into Jayous village, east of Qalqilya. They patrolled in the streets for some time and withdrew later. No house raids or arrests were reported.

· At approximately 20:30, IOF moved into the open area between Thinnaba and Kufor al-Labad villages, east of Tulkarm. They searched the area and withdrew later. No house raids or arrests were reported.

Tuesday, 11 January 2011

· At approximately 01:00, IOF moved into Nabi Saleh village, northwest of Ramallah. They raided and searched a number of houses, but no arrests were reported.

· At approximately 01:30, IOF moved into Salfit. They raided and searched a house belonging to Dr. ‘Omar Mahmoud ‘Abdul Raziq, 52, Member of the Palestinian Legislative Council (PLC) from the Change and Reform Bloc affiliated to Hamas, and arrested him. They also confiscated his mobile phone and a computer set. At the same time, IOF raided and searched the office of PLC Members from the Change and Reform Bloc in Salfit. They confiscated two computer sets and some documents and damaged the office.

· At approximately 02:30, IOF moved into Nour Shams refugee camp, east of Tulkarm. They raided and searched a house belonging to Ahmed Yousef Shabrawi. They violently beat the owner’s son, Ibrahim, 19, who is a member of the Palestinian Military Intelligence Service. They then arrested the owner’s child, 16-year-old Mohammed, and confiscated a computer set, two mobile phones, Ibrahim’s uniform and some flags and portraits. During the house raid, IOF turned a nearby building belonging to the Miqbel family into a military site. At approximately 03:00, IOF moved westward. They surrounded a house belonging to Mohamed Fayad al-Sheikh Yousef. They called through megaphones on residents of the house to get out and they did. When the residents got out, Israeli soldiers checked them, searched the house and arrested Mahdi Mohammed al-Sheikh Yousef, 18.

· At approximately 11:00, Israeli naval troops arrested 4 Palestinian fishermen, including two children, when they were sailing 2.5 nautical miles away from Gaza beach. They released 3 fishermen, but kept the fourth one, Mohammed Khaled Abu ‘Omaira, 19. The other fishermen are:

1. Ussama Nasser Abu ‘Omaira, 18;

2. Mahmoud Khaled Abu ‘Omaira, 16; and

3. Saher Khaled Juha, 16.

· At approximately 23:30, an Israeli warplane fired a missile at a site of the ‘Izziddin al-Qassam Brigades (the armed wing of Hamas) near al-Shuhada intersection, south of Gaza City. No casualties were reported.

Wednesday, 12 January 2011

· At approximately 00:25, Israeli warplanes bombarded a training site of the al-Quds Brigades (the armed wing of Islamic Jihad) in the west of the southern Gaza Strip town of Khan Yunis. The site was damaged, but no casualties were reported.

· At approximately 00:45, Israeli warplanes bombarded a site of the Palestinian naval police in the west of al-Nussairat refugee camp in the central Gaza Stip. Two rooms in the site were destroyed and a two police vehicles were damaged. No casualties were reported.

· At approximately 10:00, IOF moved into Silwan village to the south of the old town of Jerusalem. They surrounded a sit-in tent in al-Bustan quarter, while the local committee of the quarter was holding a meeting. Israeli soldiers arrested 3 Palestinian civilians, including two children:

  1. Mohammed Ayman al-Shwaiki, 14;

2. Use of Excessive Force against Peaceful Demonstrations Protesting Settlement Activities and the Construction of the Annexation Wall

During the reporting period, IOF used force against peaceful demonstrations organized by Palestinian civilians and international and Israeli human rights defenders in protest to the construction of the Wall and settlement activities in the West Bank. As a result, 4 Palestinian civilians, including a child, were wounded. Dozens of Palestinian civilians and human rights defenders also suffered from tear gas inhalation and others sustained bruises. Additionally, IOF arrested a Palestinian civilian.

· Following the Friday Prayer on 07 January 2011, dozens of Palestinian civilians and international and Israeli human rights defenders organized a peaceful demonstration in Bil’ein village, west of Ramallah, in protest to the construction of the annexation wall. The demonstrators included a number of PLC Members; Israeli Knessent Member Mohammed Baraka; Ms. Louisa Morgantini, former Deputy Speaker of the European Parliament; and a number of observers from the UN Office of the High Commissioner for Human Rights, the EU and the US consulate. The demonstrators raised the Palestinian flag and portraits of Bassem and Jawaher Abu Rahma, who were killed by IOF in the village. They moved towards the annexation wall. Israeli soldiers stationed in the area fired rubber-coated metal bullets, sound bombs and tear gas canisters at the demonstrators. As a result, 3 Palestinian civilians, including a child, were wounded:

1. Eyad Bernat, 39, hit by a tear gas canister to the right hand;

2. ‘Ouda Abu Rhama, 21, hit by a tear gas canister to the right hand; and

3. Mahmoud Yousef Abu Rahma, 16, injured in the right hand.

Additionally, a number of demonstrators suffered from tear gas inhalation and others sustained bruises as they were beaten by Israeli soldiers.

· Also following the Friday Prayer on 07 January 2011, dozens of Palestinian civilians and international and human rights defenders organized a peaceful demonstration in Ne’lin village, west of Ramallah, in protest against the construction of the annexation wall. They clashed with Israeli troops positioned near the Wall. Israeli troops fired rubber-coated metal bullets, sound bombs and tear gas canisters at demonstrators. As a result, dozens of demonstrators suffered from tear gas inhalation, and others sustained bruises.

· Also following the Friday Prayer on 07 January 2011, dozens of Palestinian civilians and international and Israeli human rights defenders organized a peaceful demonstration in Nabi Saleh village, northwest of Ramallah, in commemoration of the late Palestinian President Yasser Arafat, and in protest against land confiscations in the Wad al-Raya area between the villages of Nabi Saleh and Deir Nizam. When the demonstrators attempted to reach areas of land seized by Israeli settlers near “Halmish” settlement, Israeli troops fired rubber-coated metal bullets, sound bombs and tear gas canisters at them. As a result, Eyas Mohammed Sarhan, 23, was hit by a tear gas canister to the right foot. A number of demonstrators also suffered from tear gas inhalation. IOF also arrested ‘Odai ‘Abdul Hafiz Tamimi, 21.

3. Extra-Judicial Executions

During the reporting period, IOF committed two extra-judicial executions. In the first attack, IOF killed and old man and arrested the targeted person in Hebron. IOF admitted responsibility for the attack, but claimed that Israeli soldiers fired at the victim by mistake. In the second attack, IOF extra-judicially executed an activist of al-Quds Brigades (the armed wing of Islamic Jihad) in the southern Gaza Strip town of Khan Yunis. According to investigations conducted by PCHR:

· At approximately 03:30 on Friday, 07 January 2011, IOF besieged a 4-storey apartment building in al-Sheikh quarter in the center of Hebron. The stormed the second floor of the building, where ‘Omar Saleem Suleiman al-Qawasmi, 66, lives with his wife and their disabled son. Al-Qawasmi is a relative and a neighbor of an activist of Hamas. Israeli soldier broke into the house pointing their guns in the face of the wife who was awake. They then fired at al-Qawasmi who was sleeping from a range of two meters. He was instantly killed. Parts of his brain fell onto the bed. They then took the wife and her disabled son Yousef, 45, out of the room. When they verified that the victim was not the wanted person, Wa’el Sa’id al-Beitar, they left the house taking the victim’s body with them. They raided the first floor of the building and arrested al-Beitar. Later, IOF delivered al-Qawasmi’s body to an ambulance of Palestinian Red Crescent Society. According to medical sources, the victim was hit by many bullets, mostly in the head and the chest, and parts of his face and head were crushed. An Israeli military spokesman claimed that the soldiers “fired at him thinking that he was armed and might pose a threat to their lives.”

In her testimony to PCHR, Ms. Subhiya ‘Awadh al-Qawasmi, 60, the victim’s wife, stated:

“I got up to pray, and while I was praying in my bedroom where my husband was sleeping, I heard steps inside the house. I cut my prayer and looked around. I saw Israeli soldiers inside the house. They moved forward pointing their guns at me. I did not know how they entered the house. Immediately, they fired at my husband who was sleeping. I carried: ‘You killed him…’ I was extremely shocked. They shouted on me and requested me to bring my husband’s identity card. They verified it and then took me out of the room. They entered the nearby bedroom, where my disabled son, Yousef, 45, was. They checked him and took him out of the room. Israeli soldiers checked a notebook they were carrying, and asked me about the house of Wa’el al-Beitar. I told them that he lives on the first floor. Half an hour later, they left the house. I immediately went to my bedroom to check what happened to my husband, but I did not find him. I could only see much blood on the bed. I knew that Israeli soldiers took him with them before leaving the building.”

· At approximately 16:00 on Tuesday, 11 January 2011, an Israeli drone fired two missile at a person who was riding a motorcycle in Gizan al-Najjar area in the southern Gaza Strip town of Khan Yunis. The person was instantly killed. Later, he was identified as Mohammed Jameel Mousa al-Najjar, 24, an activist of the al-Quds Brigades (the armed wing of Islamic Jihad). A civilian bystander, Ahmed Mohammed al-Bayouk, 41, was wounded by shrapnel to the left hand, when he was traveling in a civilian vehicles a few meters away from the motorcycle. IOF admitted responsibility for the attack, claiming that al-Najjar was preparing for a large “terrorist attack? Inside Israel.

4. Continued Closure of the OPT

Israel has continued to impose a tightened closure of the OPT and imposed severe restrictions on the movement of Palestinian civilians in the Gaza Strip and the West Bank, including occupied East Jerusalem.

Gaza Strip

Israel has continuously closed all border crossings to the Gaza Strip for over three years. The illegal Israeli-imposed closure of the Gaza Strip, which has steadily tightened since June 2007, has had a disastrous impact on the humanitarian and economic situation in the Gaza Strip.

· The illegal closure has caused not only a humanitarian crisis but a crisis of human rights and human dignity for the population of the Gaza Strip. Measures declared recently to ease the blockade are vague, purely cosmetic and fail to deal with the root causes of the crisis, which can only be addressed by an immediate and complete lifting of the closure, including lifting the travel ban into and out of the Gaza Strip and the ban on exports. PCHR is concerned that the new Israeli policy is simply shifting Gaza to another form of illegal blockade, one that may become internationally accepted and institutionalized. Palestinians in Gaza may no longer suffer from the same shortage of goods, but they will remain economically dependent and unable to care for themselves, and socially, culturally and academically isolated from the rest of the world.

· Expanding the list of items allowed into Gaza does not change the illegality of this policy, which is inconsistent with Israel’s legal obligations both as an Occupying Power and under international human rights treaties to which it is party, such as the International Covenant on Civil and Political Rights.

· Facts on the ground refute Israeli claims with respect to the easing of the closure imposed on the Gaza Strip and the reduction of restrictions imposed on the entry of goods.

· Israeli declaration of allowing new goods to be entered into the Gaza Strip constitutes an attempt to delude the international community, as such goods do not meet the minimal needs of the Gaza Strip.

· IOF have continued to ban the entry of raw construction materials into the Gaza Strip.

· IOF have imposed a ban on all exports from the Gaza Strip.

· Israel had continued to close Beit Hanoun (Erez) crossing to Palestinian civilians wishing to travel to the West Bank and Israeli for medical treatment, trade or social visits.

· Israel has imposed additional access restrictions on international diplomats, journalists and humanitarian workers seeking to enter the Gaza Strip. They have prevented representatives of several international humanitarian organizations from entering the Gaza Strip.

· Living conditions of the Palestinian civilian population have seriously deteriorated; levels of poverty and unemployment have mounted sharply.

Movement at Border Crossings during the Reporting Period:

At approximately 13:00 on Tuesday, 01 June 2010, the Egyptian authorities decided to open Rafah International Crossing Point on the Egyptian border in both directions without specifying a date for its closure. The Egyptian decisions came following the Israeli attack on the Gaza-aid flotilla in international water. On the following morning, the crossing point was effectively opened and restricted categories of Palestinian civilians were allowed to travel through it.

Exports through Karm Abu Salem Crossing:

On Wednesday, 05 January 2011, IOF allowed the export of 31,000 flowers and 5.6 tons of strawberries.

On Thursday, 06 January 2011, IOF allowed the export of 138,000 flowers and 9.5 tons of strawberries.

On Sunday, 09 January 2011, IOF allowed the export of 207,000 flowers and 15 tons of strawberries.

On Monday, 10 January 2011, IOF allowed the export of 150,600 flowers and 3.3 tons of strawberries.

Al-Mentar (Karni) Crossing: During the reporting period, IOF partially opened the crossing on Wednesday, 05 January 2011, and allowed the entry of 2,964 tons of wheat, and 2,379 tons of fodders. IOF opened it again on Monday, 10 January 2011, and allowed the entry of 1,092 tons of wheat and 1,248 tons of fodders, and 980 tons of construction aggregate for UNRWA.

Beit Hanoun (Erez) Crossing: Israel has continued to close Beit Hanoun (Erez) crossing for the movement of Palestinian civilians. IOF have allowed only diplomats, a number of international journalists, employees of international agencies and a limited number of patients who suffer from serious diseases to pass through the crossing. They have continued to prevent Palestinian civilians from visiting their relatives who are detained in Israeli jails. The small number of patients permitted to pass through the crossing is only able to do so under severe restrictions that include prolonged checking.

The West Bank

Israel has imposed a tightened closure on the West Bank. During the reporting period, IOF imposed additional restrictions on the movement of Palestinian civilians.

· Jerusalem: IOF have continued to impose severe restrictions on the movement of Palestinian civilians to and from the city. Thousands of Palestinian civilians from the West Bank and the Gaza Strip have been denied access to the city. IOF have established many checkpoints around and inside the city. Restrictions of the movement of Palestinian civilians often escalate on Fridays, preventing Muslim Palestinians from praying at al-Aqsa Mosque.

· Ramallah: IOF have continued to impose severe restrictions on the movement of the Palestinian civilians in Ramallah. IOF troops positioned at the Jaba’ and Qalandiya checkpoints, southeast of Ramallah, have imposed additional restrictions on movement and conducted prolonged checks of Palestinian civilians. During the reporting period, IOF established a number of temporary checkpoints, and stopped and searched Palestinian civilian vehicles. At approximately 20:30 on Thursday, 06 January 2011, IOF established a checkpoint at the entrance of Beit Liqya village, west of Ramallah. They stopped and searched Palestinian civilian vehicles. At approximately 22:00, IOF established a checkpoint under Kharabtha al-Misbah Bridge, west of Ramallah. They stopped and searched Palestinian civilian vehicles. At approximately 08:00 on Friday, 07 January 2011, IOF re-established their presence at ‘Attara checkpoint at the northern entrance of Bir Zeit village, north of Ramallah. They stopped and searched Palestinian civilian vehicles. IOF re-established their presence at the same checkpoint again on Tuesday morning, 11 January 2011.

· Qalqilya: IOF have continued to impose severe restrictions on the movement of Palestinian civilians. On Saturday, 08 January 2011, IOF established 5 checkpoints around Qalqilya. On Sunday, 09 January 2011, IOF established 6 checkpoints around Qalqilya. Israeli soldiers stationed at these checkpoints stopped and searched Palestinian civilian vehicles.

· Tulkarm: IOF have continued to impose severe restrictions on the movement of Palestinian civilians. At approximately 15:30 on Thursday, 06 January 2011, IOF established a checkpoint on Tulkarm-Qalqilya road. They stopped and searched Palestinian civilian vehicles. At approximately 17:30 on the same day, IOF established a checkpoint at al-Jaroushiya intersection, north of Tulkarm. They stopped and searched Palestinian civilian vehicles. At approximately 13:35 on Monday, 10 January 2011, IOF established a checkpoint on Bal’a-‘Atatra road, northeast of Tulkarm. They stopped and searched Palestinian civilian vehicles.

· Jenin: IOF have continued to impose severe restrictions on the movement of Palestinian civilians. At approximately 09:30 on Friday, 07 January 2011, IOF established a checkpoint at Rummana intersection, northwest of Jenin. They stopped and searched Palestinian civilian vehicles. At approximately 11:00 on the same day, IOF established a checkpoint on Zabbouba-Ta’nak road, northwest of Jenin. They stopped and searched Palestinian civilian vehicles. At approximately 12:00 on Saturday, 08 January 2011, IOF established a checkpoint at Rummana intersection, northwest of Jenin. At approximately 11:30 on Monday, 10 January 2011, IOF established a checkpoint at Fahma intersection, southwest of Jenin. They stopped and searched Palestinian civilian vehicles. At approximately 12:00 on the same day, IOF established a checkpoint at Kufor Ra’ei intersection, southwest of Jenin. At approximately 17:00, IOF established a checkpoint at ‘Ejja intersection, south of Jenin. Israeli soldiers positioned at these checkpoints stopped and searched Palestinian civilian vehicles.

· Salfit: IOF have continued to impose severe restrictions on the movement of Palestinian civilians. IOF have continued to close the northern entrance of Salfit with cement blocks and sand barriers since 2000. They have also continued to close two roads linking Marda village with agricultural land belonging to it. At approximately 13:00 on Sunday, 09 January 2011, IOF established a checkpoint at the entrance of Yassouf village, east of Salfit. They stopped and searched Palestinian civilian vehicles.

Arrests at Military Checkpoints

· On Thursday evening, 06 January 2011, Israeli soldiers positioned at a checkpoint established at Kfar Etzion intersection on Hebron-Bethlehem road arrested Shadi Sharif Jaradat, 28, from Sa’ir village northeast of Hebron.

· On Saturday afternoon, 08 January 2011, Israeli soldiers positioned in the old town of Hebron arrested Fakhri Hassan Salaima, 17.

4. Measures Aimed at Creating a Jewish Demographic Majority in Jerusalem

Israel has recently escalated arbitrary measures against Palestinian civilians in East Jerusalem in order to force them to leave the city. PCHR has devoted this section in the Weekly Report to highlighting violations of human rights perpetrated by IOF against Palestinian civilians in East Jerusalem.

· At approximately 04:30 on Sunday, 09 November 2011, IOF, accompanied by bulldozers, moved into Sheikh Jarrah neighborhood in East Jerusalem. They besieged the headquarters of Hajj Amin al-Husseini, mufti of Jerusalem and Arab nationalist leader during British rule of Palestine, which is known as “Shepherd Hotel.” They demolished the northern part of the building, which was added to the structure in the 1960s, before the heirs of Hajj Amin al-Husseini were able to obtain a court ruling suspending the demolition of the structure, which was built in the 1930s, indefinitely. IOF claim that the land on which the structure stands belongs to Miskowitz, a Jewish US millionaire, and that he took all necessary steps to demolish the building, including the claimed that the building does not have any historic significance. IOF further claim that they confiscated with the law on properties of absentees. Moskowitiz claims that he owns the land and he wants to demolish the building to establish a new Israeli settlement.

· At approximately 07:30 on Tuesday, 10 January 2011, IOF, accompanied by a bulldozer, moved into al-Tour area in East Jerusalem. They demolished a horse stable belonging to Maher Bassem Sbaitan. The Israeli nature protection authority claims that the land, on which the stable used to stand, is an Israeli public land. However, Shukri Farrouji stresses that he has official ownership documents of the land.

· On Tuesday noon, 10 January 2011, IOF, accompanied by a bulldozer, moved into Wad al-Jouz area in East Jerusalem. They demolished a horse stable belonging to ‘Essam Dkaidek, and confiscated two horses.

· On Wednesday morning, 12 January 2011, IOF removed a commercial kiosk of kitchen tools belonging to Wa’el al-Razem in Sultan Suleiman Street in Jerusalem. IOF also confiscated goods. According to al-Razem, he establishes the kiosk more than 11 years ago, and he had not received any warning to remove it. He estimated his loss at approximately 150,000 NIS.

5. Settlement Activities and Attacks by Settlers against Palestinian Civilians and Property

Israel has continued its settlement activities in the OPT in violation of international humanitarian law, and Israeli settlers have continued to attack Palestinian civilians and property.

· On Saturday, 08 January 2011, Israeli settlers from “Gilad” settlement, east of Qalqilya, attacked agricultural property belonging to ‘Aadel Hassan Yamin, 54, from Jeet village northeast of Qalqilya. As a result, the cover of a water hole was damaged.

· At approximately 16:00 on Monday, 10 January 2011, IOF moved into Khillat al-Jammal area in the southeast of Beit Liqya village, west of Ramallah. They handed noticed to Palestinian civilians ordering stopping the construction of a house and 3 barracks claiming that they were being built without licenses:

1. A 250-square-meter, two-storey, under-construction house belonging to Anas Fadel ‘Aassi.

2. A 1,500-square-meter barrack belonging to Mohammed Hassan Dar Mousa.

3. A 300-square-meter barrack and a 1,000-square-meter one belonging to ‘Ali Shukri ‘Aassi.

· At approximately 08:00 on Tuesday, 10 January 2011, IOF, accompanied by bulldozers, moved into ‘Azzoun ‘Atma village, southeast of Qalqilya. They demolished two houses:

1. A 150-square-meter house belonging to Samer Mohammed Younis, in which 5 individuals live.

2. A 120-square-meter house belonging to Mo’in Ameen Younis, in which 8 farmers live.

These house are located nearly 500 meters away from “Oranit” settlement and nearly 120 meters away from the annexation wall.

· On Wednesday, 12 January 2011, during a wide scale military operation, IOF demolished several Palestinian civilian facilities in the southeast of Yatta town, south of Hebron. They demolished 11 houses, in which 27 individuals, including 17 children, live, 3 classrooms, 3 barnyards and 3 tents claiming that they are close to the annexation wall. According to investigations conducted by PCHR, at approximately 07:40, IOF, accompanied by bulldozers, moved into the area after declaring it a closed military zone. They surrounded the elementary school in the area and forced teachers and students out. They then demolished 3 classrooms. IOF then moved towards the residential community in the area. They forced residents of a number of houses out and demolished them together with a number of barnyards. These houses belong to:

1. Ibrahim Mohammed Ka’abna (a 220-square-meter barnyard belonging to him was also demolished.

2. Yousef Ibrahim Ka’abna.

3. Hussein Ibrahim Ka’abna.

4. ‘Adnan Ibrahim Ka’abna.

5. Jameel Suleiman al-Najajda (two barnyards belonging to him were also demolished).

6. Khaled Jameel al-Najajda.

7. Ibrahim Jameel al-Najajda.

8. Mikhled Jameel al-Najajda.

IOF also arrested 3 Palestinian civilians: Jasser Suleiman al-Najajda, 32; Nawaf Suleiman al-Qurb, 29; and Wa’el Isma’il Tmaizi, 41.

Recommendations to the International Community

1. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to fulfill their legal and moral obligations under Article 1 of the Convention to ensure Israel’s respect for the Convention in the Occupied Palestinian Territory. PCHR believes that the conspiracy of silence practiced by the international community has encouraged Israel to act as if it is above the law and encourages Israel continue to violate international human rights and humanitarian law.

2. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to convene a conference to take effective steps to ensure Israel’s respect of the Convention in the OPT and to provide immediate protection for Palestinian civilians.

3. PCHR calls upon the High Contracting Parties to the Fourth Geneva Convention to comply with their legal obligations detailed in Article 146 of the Convention to search for and prosecute those responsible for grave breaches, namely war crimes.

4. PCHR calls for the immediate implementation of the Advisory Opinion issued by the International Court of Justice, which considers the construction of the Annexation Wall inside the West Bank illegal.

5. PCHR recommends that international civil society organizations, including human rights organizations, bar associations and NGOs, participate in the process of exposing those accused of grave breaches of international law and urge their governments to bring the perpetrators to justice.

6. PCHR calls upon the European Union to activate Article 2 of the Euro-Israel Association Agreement, which provides that Israel must respect human rights as a precondition for economic cooperation between the EU states and Israel. PCHR further calls upon the EU states to prohibit import of goods produced in illegal Israeli settlements in the OPT.

7. PCHR calls on the international community to recognize the Gaza disengagement plan, which was implemented in September 2005, for what it is – not an end to occupation but a compounding of the occupation and the humanitarian crisis in the Gaza Strip.

8. In recognition of ICRC as the guardian of the Fourth Geneva Convention, PCHR calls upon the ICRC to increase its staff and activities in the OPT, including the facilitation of family visitations to Palestinian prisoners in Israeli jails.

9. PCHR appreciates the efforts of international civil society, including human rights organizations, bar associations, unions and NGOs, and urges them to continue their role in pressuring their governments to secure Israel’s respect for human rights in the OPT and to demand Israel end its attacks on Palestinian civilians.

10. PCHR calls upon the international community to pressure Israel to lift the severe restrictions imposed by the Israeli government and its occupation forces on access for international organizations to the OPT.

11. PCHR reiterates that any political settlement not based on international human rights law and humanitarian law cannot lead to a peaceful and just solution of the Palestinian question. Rather, such an arrangement can only lead to further suffering and instability in the region. Any peace process or agreement must be based on respect for international law, including international human rights and humanitarian law.
